Will take call on disqualification soon: Maharashtra speaker after SC verdict

By Mustafa Shaikh: After the Supreme Court’s verdict in the Sena (UTB) vs Sena (Shinde camp) case on Thursday, the speaker was asked to decide on the petition for the disqualification of Shiv Sena MLAs. The big question arises that which political party’s whip, Shinde or Uddhav faction, will be applied while deciding on the disqualification of the MLAs.

The decision will be taken by Speaker of Maharashtra Assembly Rahul Narvekar, who is currently outside India. Narvekar addressed a press conference online after the Supreme Court gave its verdict.

Addressing the press conference, Rahul Narvekar welcomed the court’s decision and said the jurisdiction of the Executive, Legislature and Judiciary has been defined. The court has recognised the authority of the Speaker of an assembly, he added.

According to the 10th schedule of the constitution, the whip of the political party should be implemented, the Supreme Court said. The decision regarding which faction of the political party is appropriate is given to the Speaker of the Legislative Assembly.

“We will have a hearing on the disqualification of MLAs in the near future and will take appropriate decision on it,” said Rahul Narvekar.

Narvekar also said that he will take the decision taking the right amount of time. “We will give opportunity to all the petitioners to present their views in accordance with the principle of natural justice, by following all rules,” he added further.

“Let’s take a decision considering the constitutional matter. Such decisions will serve to strengthen parliamentary democracy,” said Rahul Narvekar.

Narvekar further said, “We will take a decision on the petition as soon as possible. It won’t take long, but there will be no delay. No hasty decision will be taken, as that might lead to injustice.”

“It is not possible to say how much time it will take, but it will take time,” added Rahul Narvekar at a press conference.

On being asked, which political party’s whip will be applied, Narvekar explained that the whip will be applied according to the method of appointing the whip.
